COMPETITION TERMS AND CONDITIONS
These terms and conditions apply in conjunction with Prime Radio General Contest Rules. Where there is any inconsistency, these terms and conditions will prevail.

Entry is open to adults over the age of 25years with a current Australian Drivers License. Participants can only enter once. Employees and their immediate families of Prime Radio including all associated sponsors and participating companies are ineligible to enter.

1. DURATION
The promotion will be active Monday16th of June 2008 at 05.30am AEDST to Thursday 26th June until 8.00am AEDST. With the Draw taking place after 8am on Thursday 26th June 08. 

2. METHOD OF ENTRY & SELECTION OF WINNERS
Participants ring the station to gain entry for the Mid Year Mid Life Crisis. They will be asked their Name, Phone Number, Suburb, DOB and if they have a current Australian drivers license. Only their name will be mentioned on air. 

3. PRIZE
Major prize: The winner will get to travel to Port Douglas in a BMW Z4 Coupe’ Valued at over $100,000*. plus..

*The BMW Z4 Coupe is only used for the period of 25- 29th July 08. The car is the property of BMW and is a hire car only! Not to be damaged, sold or used in any illegal manor. Any fines occurred during this time is the winners responsibility, any damage caused will be at the winners responsibility.  The car is to return at the time allocated. Only the person who has won the prize may drive the vehicle. 

* Z4: The use of this vehicle will remain subject to the term and conditions of the standard "vehicle loan agreement" with Townsville BMW

*Prime radio is not responsible for any damaged caused to the accommodations, the winner will be responsible to pay for any outstanding fees that may occur with room damage.  Room service and other expenses not listed in the prize description are to be paid for by the Winner (if they occur). 


4. USE OF PHOTOS etc.
It is a condition of entry that Prime Radio has the right to publicise the names, characters, likenesses or voices of any
contestants for any promotion or matter incidental to the competition. The winner may also be required by Prime Radio
to participate in a photo, video and/or film session and acknowledges that Prime Radio has the right to use such
publicity photos, videos and/or films in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that person advises Prime Radio at the time of entering the competition that he/she wishes to retain his/her
anonymity.

Contestants also acknowledge that their photo may be used for a promotional display at the prize provider’s location. Contestants consent to their entry being read out on air and to their telephone and other conversations with Prime Radio being broadcast on air.

5. INDEMNITY
All contestants release from, and indemnify Prime Radio Pty Ltd (ACN   ) against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including (but not limited to) loss of income, personal
injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

6. NOTIFICATION
The winner will be notified by phone, please provide a number that can be reached on Thursday 26th June 08 after 8am. 

7. COPYRIGHT
By entering this competition all entrants:
• consent to Prime Radio making copies of the whole or any part of their entry
• grant to Prime Radio Pty Ltd all present and future copyright and all other rights in their entry in all media (including,
without limitation, the internet) and whether in existence now or created in the future
• undertake to Prime Radio Pty Ltd that their entry is not in breach of any third party intellectual property rights.
8. Judges’ decision is final and no correspondence will be entered into. Prizes cannot be transferred. Prizes cannot be redeemed for cash.
9. The promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit their prize in whole and no substitute will be offered.
10. Winners will be responsible for any and all taxes incurred in relation to their receipt of their prize(s). Winners should seek independent
financial advice prior to accepting a prize.
11. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
12. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorized intervention, computer virus, mobile phone failure, tampering, fraud or any other causes
13. beyond the control of Prime Radio which corrupts or affects the administration, security, fairness, integrity or
proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
14. Prime Radio Pty Ltd will not be responsible or liable if for any reason beyond their reasonable control any element
of any prize is not provided. Prime Radio may at its absolute discretion substitute a different prize in place of any
prize referred to in these terms and conditions, pending state approval.
15. All winners of all prizes must sign these terms and conditions and the General Contest Rules both in a form prescribed by Prime Radio Pty Ltd in order to receive their prize.
16. The promoter may, subject to State Regulations, terminate this competition at any time at its absolute discretion without liability to any contestant or other person.
17. In all matters, all decisions of Prime Radio staff will be final and cannot be contested. No correspondence or
discussions will be entertained.
18. Obtaining time off work and/or study or related activities to participate in this competition will be the sole and absolute responsibility of each contestant.
19. Prime Radio reserves the right to exclude any persons from the competition on the ground of their medical
condition or history or any reason whatsoever.
20. The personal information supplied by entrants when entering this competition will be used Prime Radio to
conduct the competition, to contact entrants if they are a winner and in accordance with Prime Radio Privacy
Policy. The information may also be included in database/s maintained by Prime Radio used to let entrants know
about special offers from the promoter and new developments. Please refer to our Privacy Policy for more information, as entry in this contest is an agreement to be bound by that policy. Our current Privacy Policy is available from Prime Radio at 5 Martinez Ave, The Lakes . Any entrants may have their details removed from Prime Radio
database/s at any time by simply contacting the promoter. If details are removed prior to the conclusion of the competition and/or award of prize(s), entrants will forfeit their right to claim any prizes. If you do not wish to receive communications from Prime Radio please check the relevant box on the entry form or advise a Prime Radio staff member when entering the competition.
